Your Rights

In addition to your usual rights in the criminal case, if you have been arrested for Driving Under the Influence, you also have a rights with the Department of Motor Vehicles (DMV) .  You have a right to have the automatic suspension of your Driver’s License reviewed by a DMV hearing officer.  You can also petition the DMV for a hardship license and for other special allowances.  Ms. Zima can represent you in both your criminal case and with the DMV.  Call Rebecca Zima at 904.215.3030 for a free consultation. 

Time Limit for Driver's License Review

To get a DMV hearing to review the suspension of your Driver’s License based on a DUI arrest, it must be requested within 10 days of your arrest or the right is waived.   If you do request a DMV DL hearing within those 10 days, the suspension of your Driver’s License is delayed for another 45 days pending that hearing.  Call Rebecca Zima at 904.425.0038 for a free consultation. 

Should you get a private attorney?

If you do not retain a private attorney to represent you, you will likely be appointed a Public Defender.  While Public Defenders do a good job, they have high caseloads and may not be able to provide you with the individual attention you would receive if you retain a private attorney.  A Public Defender only represents you for the criminal charge, Public Defenders do not attend or request DMV hearings.
